Why You Should Dial In

On November 13th, 2009, after over four years of litigation, the parties in the Google Book Search Copyright Class Action, Authors Guild, et al. v. Google Inc., No. 05 CV 8136 (S.D.N.Y.), announced a revised settlement agreement which amended the parties and dropped some foreign class members, but continued to use a class action device to grant a compulsory license. Signed initially in October 2008, this settlement agreement grants Google an unprecedented catalog of printed material, marking a sea change in the way that books are owned and distributed. Its effects on consumers, on the marketplace, and on copyright and antitrust law will be staggering. The earlier settlement already faced challenges from authors and publishers not represented under the agreement, and from the Department of Justice concerning the copyright and antitrust legality of the agreement. The issues abound substantively and procedurally. With the final Fairness Hearing now set for February 18th, the ninety days to that date will be interesting ones.

Continuing Education Credits

This TeleBriefing qualifies for 1.0 Washington CLE credit. Upon request, we will apply for CLE credits in other states and other types of credits. Please note that audio programs currently do not qualify for CLE credits from the Delaware, Kansas, and Ohio bar associations.

Kate Spelman, Moderator, co-founder of Cobalt LLP, has extensive experience in copyright, media and licensing issues. She advises on the development, production, sale and defense of copyrights and other nonpatent intellectual property; and is listed in “The Best Lawyers in America.

Cynthia S. Arato is a partner at Macht, Shapiro, Arato & Isserles LLP, which represented a number of foreign publishers and publishing associations in filing objections to GBS1. Ms. Arato’s practice focuses on intellectual property, media and entertainment and commercial and civil litigation. She has successfully represented major corporations and prominent individuals in copyright, trademark, defamation, right of publicity, false advertising, employment, contract, fraud, fiduciary duty, and royalty actions, and regularly advises clients on a wide range of intellectual property matters, including trademark and right of publicity issues related to advertisements and products.

Scott E. Gant is a Partner in Boies, Schiller & Flexner LLP’s Washington, DC office. His main practice areas include commercial litigation, class actions (for plaintiffs and defendants), antitrust and constitutional law, at the trial and appellate levels. He is also an Adjunct Professor of Law at Georgetown Law School. In June 2007, Simon & Schuster’s Free Press published Mr. Gant’s first book, We’re All Journalists Now: The Transformation of the Press and Reshaping of the Law in the Internet Age.

Daniel J. Gervais, Ph.D., Professor of Law and Co-Director of the Technology and Entertainment Law Program at Vanderbilt University Law School, focuses on international IP law and has addressed policy issues at the World Trade Organization (WTO), the World Intellectual Property Organization (WIPO), CISAC, the OECD and CCC.
