Passed on June 10, 2010, the new law requires that sellers of commercial real estate supply a completed disclosure form detailing any previous “environmental conditions” to any prospective buyers prior to concluding a commercial property transaction. The first of its kind in the nation, the new law was implemented in an effort to clarify prevailing disclosure requirements that have been known to make transactions more complex.

The recent Federal Circuit ruling in Stauffer v. Brooks Brothers reaffirmed standing for qui tam plaintiffs under 35 U.S.C. Section 292. Coming in the wake of Forest Group v. Bon Tool, which opened the door to potentially large false marking penalties by imposing fines on a per article basis, and Pequignot v. Solo Cup, which addressed the burden of proof required to prove intent to deceive under the false marking statute, the Staufferdecision marks the latest in a string of important recent false patent marking decisions.
